Employment Discrimination

Our employment attorneys have represented hundreds of clients who have been victims of sexual harassment, racial discrimination, disability discrimination under the Americans with Disabilities Act (ADA), discrimination based upon use of medical leave protected by the Family and Medical Leave Act (FMLA), and discrimination based on age, sexual orientation, national origin, religion, military status, and other protected characteristics. Employees must be able to negotiate the terms and conditions of their work. If there is a termination, we are prepared to offer legal counsel with respect to any proposed severance agreement, which usually involves the waiver of important legal rights. We have significant experience drafting, reviewing, negotiating, and litigating restrictive covenant agreements (including confidentiality, non-competition, and non-solicitation agreements), as well as other employment-related contracts.

We handle cases against employers that violate the Fair Labor Standards Act (FLSA). If you are a worker that is not being paid minimum wage or denied overtime for hours worked over 40 in a week, you may be entitled to compensation, even if your employer claims you are not entitled to the pay.

Attorney Dan Werner is a nationally respected expert in forced labor and labor trafficking law. He regularly represents clients with claims under the Trafficking Victims Protection Act (TVPA), which provides a civil claim to individuals who are forced into work by threats of harm, including threats of financial penalties.

Our employment lawyers have fought and won cases for clients whose employers violated this federal law prohibiting employment discrimination against people with disabilities.
